1. Acceptance of Terms

By accessing this website and/or participating in any classes, lessons, workshops, or activities (collectively, the “Services”) offered by Ninja Cat Enterprises Inc (“Company”, “we”, “us”), you agree to be bound by these Terms and Conditions.

If you do not agree, you must not participate in the Services.


2. Nature of Services

We provide instructional services in staff spinning and related movement arts, delivered:

  • Online (live or pre-recorded), and/or
  • In person at various locations

These activities involve physical movement and inherent risks.


3. Eligibility

You confirm that:

  • You are at least 18 years old, or have parental/guardian consent
  • You are physically and mentally capable of participating
  • You will follow all instructions and safety guidelines

4. Assumption of Risk

You acknowledge that participation in staff spinning involves risks, including but not limited to:

  • Physical injury (minor or serious)
  • Burns, bruises, or impact injuries
  • Property damage

You voluntarily assume all risks associated with participation, whether online or in person.


5. Health & Safety Responsibility

You agree that you are solely responsible for:

  • Ensuring your practice space is safe (especially for online classes)
  • Using appropriate equipment
  • Maintaining awareness of your surroundings
  • Stopping immediately if you feel pain, discomfort, or unsafe

For in-person sessions, you agree to follow all safety instructions provided by the instructor.


6. Release of Liability

To the fullest extent permitted under the laws of British Columbia, you agree that:

Ninja Cat Enterprises Inc, its owners, instructors, contractors, and affiliates shall not be liable for:

  • Any injuries, damages, or losses
  • Any indirect or consequential damages
  • Any incidents arising from misuse of equipment or failure to follow instructions

This applies to both online and in-person participation.


7. Online Training Disclaimer

For online sessions:

  • Instruction is provided remotely and may not account for your specific environment or limitations
  • We cannot guarantee real-time correction or supervision
  • You accept full responsibility for your safety during online participation

8. Equipment Use

You are responsible for ensuring that:

  • Your staff and any equipment are safe and in good condition
  • You use equipment appropriately and at your own risk

We are not responsible for equipment-related injuries or failures.


9. Code of Conduct

You agree to:

  • Behave respectfully toward instructors and other participants
  • Follow all instructions
  • Not engage in reckless, disruptive, or unsafe behavior

We reserve the right to remove participants from sessions without refund for unsafe or inappropriate conduct.


10. Payments

  • All prices are listed and charged in United States Dollars (USD)
  • You are responsible for any currency conversion fees, bank charges, or taxes that may apply
  • Payment must be made in full prior to participation unless otherwise agreed

For recurring payments or subscriptions (if applicable):

  • You may cancel your payments at any time through your payment provider or account settings
  • Cancellation will stop future billing but does not automatically trigger a refund for past payments

11. Refund Policy (Satisfaction Guarantee)

We stand behind the quality of our instruction and aim to ensure a positive experience.

Account & Subscription Cancellation

  • You may cancel your account or subscription at any time on your own, without needing to contact us
  • Cancellation can be completed through your account or payment provider
  • Once cancelled, future billing will stop

You are responsible for managing your own subscription and cancellation.

If you need assistance:

  • We are happy to help cancel your account or payments if you request support
  • We do not cancel accounts on your behalf unless you ask us to do so

Refunds (Satisfaction Guarantee)

  • Refunds are available upon request
  • Refunds are intended primarily for situations where you were unable to cancel or need assistance resolving a billing issue
  • If you are not satisfied, you may still request a refund and we will review it in good faith

Refund Limitations

We reserve the right to:

  • Deny refunds in cases of abuse, repeated refund requests, or violation of these Terms
  • Issue full or partial refunds depending on the circumstances

Good Faith Policy

Our goal is to keep things simple and fair:

  • You control your subscription
  • You can cancel at any time
  • We’re here to help if you need it

12. Cancellations & Rescheduling

  • We may reschedule or cancel sessions due to instructor availability, weather, safety concerns, or other unforeseen events
  • In such cases, you may be offered:
    • A rescheduled session
    • Credit toward future sessions
    • A refund

13. Intellectual Property

All content provided (videos, lessons, materials) is owned by Ninja Cat Enterprises Inc.

You may not:

  • Reproduce, distribute, or share content without permission
  • Record sessions without prior written consent

14. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the Services.


15. Indemnification

You agree to indemnify and hold harmless Ninja Cat Enterprises Inc from any claims, damages, or expenses arising from:

  • Your participation in the Services
  • Your breach of these Terms
  • Your misuse of equipment or instruction

16. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.


17. Changes to Terms

We may update these Terms at any time. Continued use of Services constitutes acceptance of updated Terms.
